Injured on holiday in Georgia — claiming compensation
If you were injured through someone else's fault while in Georgia — at a hotel, in transport, at a resort or on a tourist activity — under the Civil Code you can claim treatment costs, lost income and non-pecuniary damages. We help you establish who is liable and recover the damage.

A person who unlawfully, intentionally or negligently causes damage to another must compensate it (Civil Code, Article 992).
The limitation period for a damages claim is 3 years from the moment the victim learned of the damage or of the person liable for it (Article 1008).
When the owner is liable regardless of fault
- The owner of a vehicle used to carry passengers must compensate the damage if its operation caused death, disablement or harm to health, or damage to property. Force majeure releases the owner, except for air transport (Article 999).
- The owner of a structure or object that poses an increased danger must compensate the damage caused when that danger materialises; damage caused by force majeure is excluded, except in cases listed in the law — for example, an accident on power lines (Article 1000).
- Damage to health during treatment in a medical institution is compensated on the general grounds; the institution is released if it proves it was not at fault (Article 1007).
What can be claimed
- The liable person must restore the situation that would have existed had the damage not occurred (Article 408, part 1).
- You may claim treatment costs in advance (Article 408, part 3).
- If you lost or have reduced capacity to work, the damage is compensated by a monthly allowance; for a substantial reason you may claim a lump sum instead (Article 408, parts 2 and 4).
- Lost income is also compensated (Article 411).
- For bodily injury or harm to health you may also claim non-pecuniary (moral) damages (Article 413, part 2).
If you also contributed to the damage
If the victim's own conduct contributed to the damage, the duty and amount of compensation depend on whose fault caused the damage more. The same rule applies if the victim did not try to avoid or reduce the damage (Article 415).
