Baby born in Georgia to foreign parents — papers, citizenship

If your child is born in Georgia, the birth is registered here — whatever the parents' citizenship. But a child does not become a Georgian citizen just by being born here. We help with the documents, the apostille, the child's status and registration in your own country.

Every child born in Georgia has the birth registered (Law on Civil Acts, Article 22) — even if the parents have no legal basis to stay (Article 10). The maternity hospital sends the birth notice electronically within 5 working days; if it doesn't, or the child was born at home, the parents must apply themselves within 1 month. The birth certificate is free and issued in Georgian.

Under Article 10 of the Law on Citizenship, a child is a Georgian citizen by birth if one parent is a Georgian citizen, or if the parents are stateless persons with status in Georgia. If both parents are foreigners, the child takes the parents' citizenship — under the law of their country.

Step by step

  1. Birth registration — based on the hospital's notice; you collect the certificate at a Public Service Hall
  2. Entering the parents — by joint application or with the marriage document; a foreign marriage certificate needs an apostille and a notarised translation
  3. Apostille and translation of the birth certificate — for use in your country
  4. Registering the child at your country's consulate and getting a passport
  5. The child's status in Georgia — visa-free stay on their own passport, or a residence permit

The child's residence permit

A foreigner's minor child is a family member, so if a parent holds a residence permit, the child can get a family reunification permit (Law on the Legal Status of Aliens, Article 15). Investment permits also cover family members.

Leaving Georgia with the child

Georgian law does not require the other parent's consent for a foreign child to leave; exit can be restricted by a court decision. If the parents are in dispute, the other parent can go to court, and the Hague Convention applies to wrongful removal. Your country or the destination country may require consent — check in advance.

Questions & answers

Does a child born in Georgia become a Georgian citizen?

Not by birth alone. The child is a citizen if one parent is Georgian, or if the parents are stateless persons with status in Georgia.

How much does a birth certificate cost?

The birth certificate is free. Registration is usually done by the next working day.

How do I get the certificate recognised in my country?

It needs an apostille and a translation; then you register the child at your country's consulate.

Do I need the other parent's consent to leave with the child?

For a foreign child, Georgian law doesn't require it unless a court has restricted exit. Your country's rules may differ.
