Property crimes are covered by Chapter XXIV of the Criminal Code. The penalty depends mainly on the amount: over GEL 150 counts as significant damage, over GEL 10,000 as a large amount.
In these cases it often comes down to how the property was valued, whether there was an intent to appropriate, and what video footage or identification shows. Sometimes what is presented as a crime is really a civil dispute.
Cases we handle
- Theft — secret taking (Article 177)
- Open theft (ძარცვა, Article 178): 3 to 5 years, up to 11 with aggravating circumstances
- Robbery with violence dangerous to life or health (Article 179): 5 to 7 years, up to 15 with aggravating circumstances
- Fraud — taking by deception (Article 180)
- Extortion — demands backed by threats (Article 181): 2 to 4 years, up to 9 with aggravating circumstances
- Misappropriation or embezzlement of entrusted property (Article 182): 3 to 5 years, up to 11 with aggravating circumstances
What we check in your defence
- The valuation of the property — it decides which part of the article applies
- Whether the act is classified correctly: theft, open theft or robbery
- Whether identification, search and seizure were lawful
- Whether the case is really a civil dispute
Compensating the damage
Compensating the damage and reaching agreement with the victim can affect the sentence and the preventive measure. When and how to do it is something to decide with your lawyer.

Questions & answers
What is the difference between theft, open theft and robbery?
Theft is secret taking; open theft (ძარცვა) is taking openly, in front of others; robbery is an attack with violence dangerous to life or health, or the threat of it. Penalties get stricter in that order.
What counts as significant damage and a large amount?
For property crimes, significant damage is a value over GEL 150, and a large amount is over GEL 10,000. Both make the penalty stricter.
I couldn't repay a debt. Is that fraud?
Not necessarily. Fraud requires an intent to deceive from the start. If an obligation simply wasn't met, it is often a civil dispute.
If I compensate the damage, will the case be dropped?
Compensation doesn't end the case automatically, but it can affect the sentence, the preventive measure or the terms of a plea agreement.
