Violent crimes are acts against life and health — from beating to homicide. The penalty depends on how serious the injury is, which a medical examination establishes, and on aggravating circumstances.

These cases often start from a fight or conflict where both sides used force. So a lawyer should assess early whether it was self-defence.

Cases we handle

  • Beating or other violence causing physical pain (Article 126)
  • Intentional minor bodily injury (Article 120): 1 to 3 years
  • Intentional less serious bodily injury (Article 118): 2 to 4 years
  • Intentional serious bodily injury (Article 117): 4 to 7 years
  • Threats (Article 151)
  • Intentional homicide (Article 108): 10 to 15 years; with aggravating circumstances (Article 109) — 16 to 20 years or life

Self-defence

By law, a person who harms an attacker while defending themselves or others against an unlawful attack does not act unlawfully. This right exists even if they could have avoided the attack or called for help. The key is that the defence must not be clearly disproportionate to the attack.

What we check

  • The medical report — the severity of the injury decides the article
  • Who started the conflict and whether it was self-defence
  • Video footage and witness statements
  • Whether intent has been assessed correctly

Questions & answers

I was defending myself. Am I liable?

If it was lawful self-defence, the act is not unlawful. The question is whether the defence was clearly disproportionate to the attack. A lawyer proves this with evidence.

How is the severity of an injury decided?

By a medical examination. Minor, less serious and serious injuries fall under different articles — 1 to 3 years, 2 to 4 years and 4 to 7 years.

There was a fight and we were both hurt. What happens?

In such cases both sides can be both victim and accused. It is important that your version and evidence are recorded correctly from the start.

What is the penalty for homicide?

Intentional homicide carries 10 to 15 years; with aggravating circumstances, 16 to 20 years or life imprisonment.
