Early release on parole in Georgia — lawyer

A person sentenced to imprisonment can be released early on parole if they have served the required part of the sentence and it is found that serving the full term is no longer needed for their rehabilitation. We help prisoners and their families prepare the application and the evidence.

Under Article 72 of the Criminal Code, early release from a fixed-term prison sentence is decided by the local board of the Special Penitentiary Service; for community service, corrective labour or house arrest — by a court. The rule does not apply to prisoners held in a special-risk facility.

A released person can be given obligations, and the probation bureau supervises their conduct. If they persistently fail to meet them or commit a new crime, the release can be revoked.

How much must be served

  • Less serious crime — at least half of the sentence
  • Serious crime — at least two-thirds
  • Especially serious crime — at least three-quarters
  • If an earlier parole was revoked — three-quarters
  • In every case at least 6 months must actually be served
