Fraud is taking someone else's property or obtaining a property right by deception, in order to keep it (Article 180 of the Criminal Code). The key question is whether there was intent to deceive from the start — if an obligation simply wasn't met, it is often a civil dispute.
Since 2025, a person convicted of large-scale fraud is ordered to pay the victim compensation and is banned from leaving Georgia until the damage is paid. That gives victims a real chance of getting their money back.
Penalties under Article 180
- Basic offence — a fine, community service, corrective labour, house arrest, or 2 to 4 years in prison
- By a group by prior agreement, or causing significant damage (over GEL 150) — a fine or 4 to 7 years
- By abusing one's position, on a large scale (over GEL 10,000) or repeatedly — a fine or 6 to 9 years
- By an organised group or by a person convicted twice or more — 7 to 10 years

Is failing to repay a debt fraud?
Not necessarily. Fraud requires intent to deceive from the start. If an obligation simply wasn't met, it is often a civil dispute.
I was scammed — can I get my money back?
The earlier you act, the better the chances: a police report, freezing the suspect's property and the compensation mechanism. In large-scale cases the convicted person is ordered to pay compensation.
What is the penalty for fraud?
For the basic offence — from a fine up to 4 years in prison; with aggravating circumstances — up to 10 years.
