Under Article 413 of the Civil Code, money for non-pecuniary (moral) damage can be claimed only in cases set by law — in a reasonable and fair amount. For bodily injury or harm to health, moral damage can always be claimed.
Other important cases are culpable harm to honour, dignity, business reputation or private life (Article 18), including publishing a photo or video without consent, and damage caused by the state through unlawful conviction or detention (Article 1005). A medical institution is liable unless it proves it was not at fault (Article 1007).

## What a court considers when setting the amount

- The severity and duration of the harm

- Pain, distress and changes to daily life

- The degree of fault of the person responsible

- How widely information was spread — for harm to reputation

- Court practice in similar cases

## Questions & answers

### When can I claim moral damage?

Only in cases set by law — for example, injury, culpable harm to honour, dignity or private life, or unlawful detention or conviction.

### How much will a court award?

There is no fixed rate. The court sets a 'reasonable and fair' amount based on the severity of the harm, fault and practice.

### I was unlawfully detained — am I owed compensation?

A rehabilitated person is compensated by the state for damage from unlawful conviction or detention — regardless of officials' fault.
