# Power of attorney to a lawyer in Georgia from abroad

You don't have to come to Georgia to deal with a matter here. From abroad, you can give a lawyer a power of attorney, and the lawyer will act in your name. Here is how to do it under Georgian law.

Under Article 103 of the Civil Code, a transaction may also be made through a representative, and a representative's authority arises from a power of attorney. The exception is when, by its nature, the transaction must be made by the person themselves, or when the law prohibits making it through a representative.
A power of attorney does not need the form required for the transaction itself, unless a special form is prescribed (Article 107). A power of attorney given by a citizen for use in court must be certified, for example by a notary (Civil Procedure Code, Article 96).

## When a lawyer needs a power of attorney

A lawyer works under a contract. Before investigative bodies and in court, the lawyer presents their licence together with an order, so a lawyer does not need a power of attorney (Law on Advocates, Article 19). The lawyer fills in the order on the form approved by the Executive Council of the Georgian Bar Association (paragraph 3 of the same article).
In other cases — for example with a notary, at the Public Registry or the Public Service Hall — a representative, including a lawyer, acts under a power of attorney (Civil Code, Article 103). These are the cases for which you need the power of attorney described below.
If a representative acts under a power of attorney in a civil or administrative case in court, certain actions must each be named specifically in the power of attorney: filing a claim, referring the case to arbitration, representation in mediation, waiving or admitting a claim, changing the subject of the claim, settlement, appealing the judgment, submitting a writ of execution, and receiving property or money (Civil Procedure Code, Article 98; in administrative cases this Code applies under Article 1(2) of the Administrative Procedure Code).

## How to certify a power of attorney from abroad

- With a notary in your country. A notary in Georgia accepts a document issued in another state if it is legalised or certified with an apostille (Law on Notaries, Article 55).

- At a Georgian embassy or consulate. Besides notaries, notarial acts are performed by authorised officials of Georgia's diplomatic missions and consular posts abroad (Article 42). Contact the embassy before you go and ask about their terms.

- Online with a Georgian notary, if you hold a Georgian residence card. According to the Notary Chamber of Georgia, the online notarial service is available to Georgian citizens and holders of a Georgian residence card, from any country in the world.

## Apostille or legalisation

A power of attorney certified abroad needs an apostille or legalisation to be used in Georgia. The exception is when an international treaty of Georgia sets a different rule — the treaty then applies (Law on Notaries, Articles 55 and 56). Such a rule exists for the countries listed below.
Country: no apostille or legalisation neededBasisAzerbaijan, Armenia, Belarus, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan, Uzbekistan, UkraineMinsk Convention 1993, Article 13BulgariaGeorgia–Bulgaria treaty (1995), Article 24TurkeyGeorgia–Turkey agreement (1996), Article 14
The list of Minsk Convention member states is taken from the official information of the Service Agency of the Ministry of Internal Affairs of Georgia. A power of attorney certified in any other country needs an apostille or legalisation — we tell you which before you sign.

## Language and translation

In Georgia, notarial acts are performed in the state language (Law on Notaries, Article 6), and court proceedings are also conducted in the state language (Civil Procedure Code, Article 9). A notary certifies the accuracy of a translation from one language into another (Article 38). We prepare the translation of a foreign-language power of attorney and have it certified.

## When a power of attorney ends

- When its term expires, if it was given for a fixed term.

- When the representative renounces it.

- When you revoke it.

- On your death.

- When the task is performed.

- If you are recognised as a recipient of support, where support was set for exercising powers of representation or disposing of property.

These grounds are in Article 109 of the Civil Code. Third parties must be informed of any change or revocation (Article 108), and once the authority ends, the representative must return the power of attorney to you (Article 110).

## Questions & answers

### Can I give a lawyer in Georgia a power of attorney from abroad?

Yes. A transaction may be made through a representative (Civil Code, Article 103). You can certify the power of attorney with a notary in your country, at a Georgian embassy or consulate, or — if you hold a Georgian residence card — online with a Georgian notary.

### Does a power of attorney certified abroad need an apostille?

As a rule, yes — an apostille or legalisation (Law on Notaries, Article 55). It isn't needed where an international treaty of Georgia sets a different rule (Article 56): documents from Azerbaijan, Armenia, Belarus, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan, Uzbekistan and Ukraine under the 1993 Minsk Convention, and from Bulgaria and Turkey under bilateral treaties.

### Can I certify a power of attorney online with a Georgian notary?

According to the Notary Chamber of Georgia, the online notarial service is available to Georgian citizens and holders of a Georgian residence card, from any country. If you don't hold a residence card, use a notary in your country or a Georgian embassy.

### Does a lawyer need a power of attorney?

Not before investigators and in court: the lawyer works under a contract and presents an order (Law on Advocates, Article 19). In other cases — for example with a notary, at the Public Registry or the Public Service Hall — the lawyer acts under a power of attorney (Civil Code, Article 103).

### Can I revoke a power of attorney?

Yes. A power of attorney ends when you revoke it (Civil Code, Article 109). Third parties must be informed of the revocation (Article 108), and the representative must return the power of attorney to you (Article 110).
