Being on the debtors' register means enforcement has started against you: selling property is restricted and bank accounts are frozen. We find out why you're on the register and how you can be removed.

Under Article 19¹ of the Law on Enforcement Proceedings, a person is entered on the debtors' register as soon as enforcement of a money claim starts against them. The register is kept by the National Bureau of Enforcement; its data are public, and an extract is issued no later than the next working day after the application, for a fee. A debtor whose debt is secured by a mortgage or pledge, for example, is not entered.
As soon as you're registered, selling or encumbering registered property — a flat, land, a car — is restricted, and banks freeze your accounts up to the amount of the claim, including newly opened ones. Being on the register doesn't cancel the debt — enforcement continues.

## When the entry is removed

- The debt is paid in full

- A fine has been replaced by another penalty

- Enforcement has ended — for example, the creditor waived it, the parties settled, the decision was quashed, or 10 years have passed since enforcement began (5 for fines)

- A court has ruled so

On removal, all restrictions are lifted.

## Selling property while on the register

Restricted property can be sold with the consent of the National Bureau of Enforcement, and in a private creditor's case with the creditor's consent too. The debt is often paid from the sale.

## Questions & answers

### How do I find out if I'm on the debtors' register?

The register's data are public. The National Bureau of Enforcement issues an extract no later than the next working day after the application, for a fee. We can check which case and which creditor you're registered for.

### I paid the debt — will I be removed automatically?

Paying in full is a ground for removal, and all restrictions are lifted on removal. If the entry hasn't been removed, you need to contact the enforcement officer — we can help.

### I'm on the register — can I sell my flat?

Only with consent: in cases for the state budget — the National Bureau of Enforcement's; in other cases — the Bureau's and the creditor's.

### I'm on the register for a very old debt — what can I do?

If 10 years have passed since enforcement of a money claim began, enforcement must end and you must be removed — except in cases set by law, such as alimony.
