# Power of attorney from abroad for use in Georgia

How to give a power of attorney from abroad for property, inheritance or court matters in Georgia: at a consulate or a local notary, apostille and translation.

Living abroad and need to sell a flat in Georgia, accept an inheritance or run a court case? You don't have to travel — a properly drafted power of attorney is enough.

## Three ways

- At a Georgian consulate — the consul certifies the power of attorney and it is valid in Georgia without further certification

- At a local notary — then, depending on the country, it needs an apostille or consular legalisation (documents from some countries need neither) and, in Georgia, a certified Georgian translation

- Online with a notary in Georgia — if you have a Georgian passport: by video call, with two witnesses present at the notary's office

## What the power of attorney should say

- Full details of both parties — names and ID or passport numbers

- Specific powers: for example, which property (by cadastral code) to sell, at what price and into whose account the money is paid

- For court — which case and which powers: filing a claim, settling, appealing

- How long it is valid and whether the representative may delegate the powers to someone else

## Why a "general" power of attorney is risky

A very broad power of attorney lets the representative deal with almost all your property. It is safer to give one for a specific matter and a reasonable period. You can revoke a power of attorney at any time — and you should notify both the representative and third parties.
