In a criminal case a court can freeze the property of the accused or a connected person, including bank accounts, if there is information that the property may be hidden or spent, or was obtained through crime (Article 151 of the Criminal Procedure Code). A verdict can confiscate the object and instrument of the crime and property obtained through crime (Article 52 of the Criminal Code).
There is a separate civil procedure: certain people — for example, public officials or persons convicted of money laundering — and their connected persons can have unlawful and unexplained property confiscated. In these cases documents proving where the property came from are decisive.

It can, if they are treated as a person connected to the accused. Then it is important to prove the property was obtained lawfully and independently.

A freeze is temporary — it restricts dealing with the property. Confiscation is final: the property passes to the state.
